TERMS AND CONDITIONS

Please read these Terms and Conditions ("Terms") carefully before using the letsball.us website or the Lets Ball USA mobile application (together or individually, the "Service") operated by Lets Ball USA LLC ("Lets Ball USA," "we," "our," or "us").
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the Terms, then you do not have permission to access the Service.

1 Participation Waiver & Release

By participating in any way in any Lets Ball USA programs, events, or activities (collectively, "Activities"), you understand, acknowledge and agree to the following:
  1. Physical Fitness. You certify that you are physically fit to participate in the Activities and have not been advised otherwise by a qualified medical professional.
  2. Rules & Inspections. You agree to comply with all rules, regulations and codes of conduct applicable to the Activities. You will inspect the equipment, facilities and premises before participating and will notify Lets Ball USA officials if anything appears unsafe.
  3. Assumption of Risk. You understand that participation involves risks of serious injury, disability, death, property loss and other damages, including risks arising from
    • the actions, inactions or negligence of Lets Ball USA or other participants;
    • facility or equipment conditions;
    • rules of play and weather;
    • the skill and condition of other participants; and
    • vehicular traffic and other unknown risks.
    YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL SUCH RISKS, WHETHER OR NOT FORESEEABLE, AND ACCEPT FULL RESPONSIBILITY FOR YOUR PARTICIPATION.
  4. COVID‑19 Specific Acknowledgment. You acknowledge the contagious nature of COVID‑19 and voluntarily assume the risk of exposure or infection, which could result in illness, disability or death. You agree to comply with all COVID‑19 protocols provided by Lets Ball USA and applicable public‑health authorities.
  5. Release & Indemnity. You, on behalf of yourself and your heirs, waive, release, and discharge Lets Ball USA LLC, its affiliates, officers, employees, volunteers, agents, sponsors, facility owners and other participants (collectively, "Releasees") from all claims and liabilities arising out of your participation. You agree to indemnify and hold the Releasees harmless against any such claims.
  6. Medical Treatment. You consent to receive medical treatment deemed advisable during the Activities and release the Releasees from any liability arising from such treatment.
  7. Media Rights. You grant Lets Ball USA the right to photograph, film and record your likeness and to use such content, with your name and biography, in any media for promotional purposes without further consideration. This grant includes any Event Footage as defined in Section 5 below, and you acknowledge that participation will result in your inclusion in Event Footage regardless of subscription status.
  8. Recording Notice & Consent. You understand and agree that all Lets Ball USA matches, events, and related activities are recorded (video and, where applicable, audio) for safety, officiating, replay, highlight creation, and promotional purposes. If you join or participate in a match or event, you will be recorded regardless of your subscription status. If you do not wish to be recorded, do not participate in the Activities.

2 Code of Conduct

The Participant's Code of Conduct applies to all Lets Ball USA participants from arrival at the facility until departure. Its purpose is to ensure a safe, respectful and inclusive environment. Violations may result in warnings, ejections, suspension, or permanent removal without refund.

2.1 Core Principles

  • Demonstrate ethical, respectful and sportsmanlike conduct.
  • Celebrate diversity, equity and inclusion; discrimination is prohibited.
  • Follow officials' decisions and league rules.

2.2 Prohibited Behavior (non‑exhaustive)

  • Derogatory or discriminatory comments.
  • Physical or verbal harassment or abuse.
  • Violence, threats, unnecessary roughness.
  • Use of alcohol, tobacco or illegal substances at facilities.
  • Property damage or facility misuse.
  • Playing under a false identity or roster fraud.
  • Downloading, screen-recording, copying, or sharing Event Footage (including in-app clips) outside the Service without written approval.

3 Privacy & Communications

Our Privacy Policy explains how we collect, use, and share your personal data. By using the Service, you consent to the practices described there.
By creating an account, you agree to receive transactional emails and, if you opt in, marketing communications. You may unsubscribe at any time via the links provided in those emails.

4 Purchases & Payments

Purchases of products or services through the Service may require you to submit payment information (e.g., credit‑card details). You represent that you have the legal right to use any payment method submitted. Payments may be processed by third‑party providers such as Stripe or RevenueCat; your information will be handled in accordance with our Privacy Policy.
We reserve the right to refuse or cancel orders for reasons including, but not limited to, availability, pricing errors, suspected fraud or other violations of these Terms.

5 Content & Footage Ownership

5.1 Definitions

“User Content” means content you create and upload to the Service (e.g., text posts, captions, comments, profiles) other than Event Footage. “Event Footage” means any full-match recordings, highlights, stills, audio-visual clips, compilations, and derivatives captured by or on behalf of Lets Ball USA from any Activities, including any user-generated clips created in-app from Event Footage. “Service Content” means the Service, Event Footage, and all other content we make available.

5.2 Ownership of Event Footage

Lets Ball USA exclusively owns all right, title, and interest in and to all Event Footage, including full matches, highlights, and any user-generated clips derived from Event Footage. To the extent you have or acquire any rights in Event Footage or derivatives thereof, you hereby irrevocably assign to Lets Ball USA all such rights, including all intellectual-property rights, and waive any moral rights to the maximum extent permitted by law.

5.3 License to Use Event Footage (End-User)

Subject to these Terms, Lets Ball USA grants you a limited, non-exclusive, revocable, non-transferable license to view Event Footage and create in-app clips solely within the Service for your personal, non-commercial use. You may not download, copy, screen-record, repost, rebroadcast, or otherwise distribute Event Footage (including in-app clips) outside the Service without our prior written approval.

5.4 User Content License to Lets Ball USA

For User Content (not Event Footage) that you post, you grant Lets Ball USA a worldwide, perpetual, irrevocable, sublicensable, royalty-free license to use, host, store, reproduce, modify, adapt, publish, translate, create derivative works from, perform, display, and distribute such User Content in connection with the Service and our business.

5.5 Publicity & Sharing by Lets Ball USA

You acknowledge and agree that Lets Ball USA may use, publish, publicly display, perform, transmit, and distribute Event Footage (including your name, image, voice, likeness, and biographical information as captured) on our websites, apps, social-media channels, promotional materials, broadcasts, and any other media now known or later developed, without additional permission or compensation, to the maximum extent permitted by law.

5.6 Prohibited Uses

You agree not to (a) download or attempt to download Event Footage; (b) screen-record or otherwise capture Event Footage; (c) share, upload, post, or stream Event Footage outside the Service; (d) commercialize Event Footage in any way; or (e) remove, bypass, or interfere with any digital rights management (DRM), watermarking, or access controls. We may disable your account and pursue remedies for violations.

6 Accounts

You must be at least 18 years old to create an account. You are responsible for safeguarding your login credentials and for activities under your account. Notify us immediately of any unauthorized use.

7 Intellectual Property

Except for user‑generated content, all materials and functionality on the Service are the exclusive property of Lets Ball USA LLC or its licensors and are protected by copyright, trademark and other laws.

8 Third‑Party Links

The Service may contain links to external websites. Lets Ball USA is not responsible for the content or practices of such sites. Your use of third‑party sites is at your own risk.

9 Termination

We may suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion. Sections that by their nature should survive termination will continue in effect.

10 Disclaimer & Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the fullest extent permitted by law, Lets Ball USA disclaims all implied warranties and will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Service.
Some jurisdictions do not allow certain warranty exclusions or liability limitations; in such cases our liability will be limited to the maximum extent permitted by law.

11 Changes to Terms

We may modify these Terms at any time. Material changes will be announced at least 30 days before taking effect. Continued use of the Service after changes become effective constitutes acceptance of the new Terms.
